Right of Withdrawal

Pursuant to Articles 52 et seq. of Legislative Decree No. 21/2014, implemented in accordance with Directive 2011/83/EU on consumer rights, a "Consumer" is defined as a natural person who makes a purchase remotely or away from business premises for purposes not related to their professional or business activity (i.e., by not indicating a VAT number on the order form). The Consumer has the right to withdraw from the purchase contract for any reason, without the need to provide a reason and without penalty, except as provided by the Consumer Code and the following clauses.

1. REQUEST METHODS

To exercise the right of withdrawal, the Customer must send to Dan iela Anselmi (hereinafter www.danyallcreations.com ), by email or registered letter, an explicit declaration of withdrawal from the contract, no later than 14 days after on the date of receipt of the goods by the same or a designated third party.

2. RETURN OF GOODS

Upon receiving the Customer's notification, Daniela Anselmi will email the Customer instructions or, if applicable, a return form with an authorization number. The return form must be attached to the outside of the package containing the returned goods. The Customer must then return the goods in their original packaging to Daniela Anselmi (at the address indicated in the return instructions: Via Sant'Antonio 42, 02015 Cittaducale (RI) ) within 14 days of receiving the authorization, via post or express courier.

3. MANDATORY CONDITIONS

The right of withdrawal is subject to the following mandatory conditions: 3.1. The right of withdrawal applies to the product purchased in its entirety; it is not possible to exercise withdrawal only on part of the purchased product. 3.2. The purchased item must be intact and returned in its original packaging, complete in all its parts (including packaging and any documentation and accessories); it is recommended to place the original packaging in a second box to avoid damage; the application of labels or adhesive tape directly on the original product packaging should be avoided. 3.3. The item must be returned without obvious signs of use, other than those compatible with a normal fitting of the item. 3.4. Shipping costs for returning the goods are the responsibility of the Customer. If the Customer asks Daniela Anselmi to organize the collection of the item on their behalf, the costs of the service performed will be charged to the Customer. 3.5. The shipment, until the receipt is confirmed at Daniela Anselmi 's headquarters, is always under the complete responsibility of the Customer. 3.6. In the event of damage to the goods during transport, Daniela Anselmi will notify the Customer of the incident (within 5 working days of receipt) to allow the Customer to file a complaint against the courier and obtain a refund (if the goods are insured). 3.7. Daniela Anselmi is not responsible in any way for damage or theft/loss of goods sent for return.

4. EXCLUSIONS

The right of withdrawal does not apply: 4.1. For all orders where the amount to be paid by the consumer does not exceed €50.00. 4.2. P for the supply of goods made to measure or clearly personalized. 4.3. For the supply of goods which are at risk of deteriorate or expire rapidly. 4.4. For the supply of sealed goods that are not suitable for return for hygiene or health protection reasons and were opened after delivery. 4.5. For Contracts concluded with Professional customers (with VAT number).

5. REFUND

In the event of a legitimate exercise of the right of withdrawal, Daniela Anselmi will refund the full amount paid, including standard shipping costs, without undue delay and in any case no later than 14 days from the date of receipt of the notice of withdrawal, upon receipt and inspection of the goods. The refund will be made using the same payment method used for the initial transaction, unless otherwise agreed (e.g., bank transfer, for which the Customer must provide the IBAN and account holder). In cases where the right of withdrawal is excluded or the indicated methods are not followed, Daniela Anselmi will return the purchased Products to the Customer, charging the Customer the new shipping costs.
